Chapter 18 - The Deposition Under Fire

Courtroom 4B was packed to standing room only by 9:00 AM on Wednesday. Judge Holbrook, a stern jurist known for his zero-tolerance policy toward procedural gamesmanship, sat upon the bench with a mountain of motions before him.

Nathan Cross sat at the plaintiff's table flanked by four senior corporate litigators in thousand-dollar suits. Cross didn't look at me; he looked bored, as if this proceeding were merely an administrative annoyance on his schedule.

Marcus Vance stood at our podium. "Your Honor, we move for the immediate dissolution of the temporary restraining order and the dismissal with prejudice of Vanguard Meridian’s claim."

Cross’s lead attorney stood up smoothly. "Your Honor, counsel is grandstanding. Vanguard Meridian is an innocent third-party purchaser of negotiable debt instruments. Under UCC Article 3, we are entitled to enforce the collateral. Miss Sterling’s personal family tragedy, while regrettable, cannot overturn commercial finance law."

"Is that so?" Marcus said, his voice ringing through the chamber like a bronze bell. "Then perhaps counsel would like to explain this."

Marcus stepped forward and handed three copies of the thumb drive transcripts directly to the clerk.

"These are authenticated, cryptographically verified email chains between Mr. Nathan Cross’s personal executive account and Greg Bennett, dated four months prior to the execution of the disputed note," Marcus declared. "In email fourteen, Mr. Cross writes: *'Make sure the mother signs alone. If Claire Sterling finds out, she will look at the title survivorship clause and ruin the foreclosure timing.'*"

The courtroom went dead silent. You could hear the faint buzz of the fluorescent lights overhead.

Judge Holbrook’s eyebrows lowered into a dangerous furrow. He adjusted his glasses, reading the printed transcript line by line.

Cross’s attorney frantically whispered into Cross’s ear, whose face had suddenly drained of all its smug color.

"Furthermore, Your Honor," Marcus continued relentlessly, "we present the original, unencumbered 1994 deed discovered last night, bearing the recorded survivorship covenant. Greg Bennett had zero legal authority to pledge this property. And Nathan Cross had full, advance knowledge of that defect. This is not a commercial dispute, Your Honor. This is an organized, predatory racketeering enterprise."

Judge Holbrook looked up from the documents, his gaze locking directly onto Nathan Cross.

"Mr. Cross," Judge Holbrook said in a low, terrifyingly calm voice. "You have thirty seconds to explain why I shouldn't refer you and your firm directly to the United States Attorney for mail fraud and wire fraud."

Cross’s lead counsel stood up, his voice cracking. "Your Honor... we request an immediate recess to confer with our client."

"Denied," Judge Holbrook slammed his gavel. The sharp crack echoed through the marble hall. "The temporary restraining order is dissolved immediately. All frozen accounts are restored with interest. And I am ordering an emergency forensic audit of Vanguard Meridian’s entire Ohio portfolio, to be overseen by an independent master."

Judge Holbrook looked down at our table. "Miss Sterling. You are appointed as special master of this court to conduct that forensic audit."
