Chapter 7 - The Emergency Hearing

On Tuesday morning at ten o'clock, Courtroom 4B of the Fulton County Superior Court was packed with attorneys, reporters, and corporate observers.
Judge Evelyn Harrison, a sixty-year-old jurist known for her razor-sharp legal acumen and zero-tolerance policy for corporate malfeasance, sat beneath the state seal, reviewing a thick stack of binders.
I sat at the plaintiff's table beside Maya, dressed in a tailored navy pantsuit, my hair pulled back into a sleek, professional chignon.
Across the aisle sat Grant Bennett and Richard Sterling. Grant looked like a man who hadn't slept in seventy-two hours. His skin was sallow, his eyes bloodshot, and his suit hung loosely on his frame. He kept his eyes fixed entirely on the polished wood of his desk, refusing to look across the aisle.
Beside Richard Sterling was an additional defense counsel—Arthur Pendelton, one of the most expensive white-collar criminal defense attorneys in the Southeast.
Judge Harrison lowered her reading glasses and tapped the papers on her desk.
"We are here on Plaintiff’s motion for an emergency injunction, asset freeze, and the appointment of a corporate receiver for Bennett Crest Development," Judge Harrison began, her voice echoing clearly in the high-ceilinged courtroom. "Mr. Sterling, I have reviewed the defense’s responsive briefing. It is remarkably light on explanations."
Richard Sterling stood up, clearing his throat nervously. "Your Honor, we submit that this is fundamentally a domestic dispute that has unfortunately bled into a commercial enterprise. My client, Mr. Bennett, has managed Bennett Crest successfully for over nine years. A temporary receivership would disrupt critical ongoing projects, specifically the Midtown Tower development, which employs hundreds of local workers."
"Mr. Sterling," Judge Harrison said, her tone dangerously calm, "I am looking at bank statements from First Georgia Bank showing that three point two million dollars was wired from an escrow reserve account—an account backed by city development bonds—directly into a shell entity controlled solely by your client."
Sterling shifted his weight. "Your Honor, those funds were intended for pre-development acquisitions—"
"Under forged architectural certifications?" Judge Harrison cut in, picking up Marcus Vance’s sworn affidavit. "Mr. Vance has provided this court with original CAD files, timestamped communications, and a forensic handwriting analysis showing that his professional seal was forged on sixteen separate payment vouchers."
Grant buried his face in his hands.
Arthur Pendelton, Grant’s criminal attorney, stood up slowly. "Your Honor, on advice of counsel, Mr. Bennett will be asserting his Fifth Amendment privileges regarding any questions related to the formation and transactions of Rosewood Holdings."
A low murmur rippled through the gallery. In a civil hearing, invoking the Fifth Amendment allows the judge to draw an adverse inference—essentially assuming that the truth would incriminate the party refusing to speak.
Judge Harrison turned her gaze toward Maya. "Ms. Rhodes, what is the plaintiff's proposed remedy?"
Maya rose smoothly, adjusting her jacket.
"Your Honor, Mrs. Claire Bennett is the co-founder, primary debt guarantor, and forty-nine percent shareholder of Bennett Crest. Furthermore, she is the sole trustee of the Vance-Bennett Capital Trust, which holds the junior debt on the Midtown Tower project. Under Article Four of the corporate bylaws, any act of criminal fraud or gross breach of fiduciary duty by the managing partner triggers an immediate buyout option for the non-defaulting shareholder."
Maya handed a certified document to the court clerk.
"We have submitted a binding recapitalization plan. Mrs. Bennett is prepared to deposit three point five million dollars of her own private capital into the depleted escrow account today. This will satisfy the city’s bonding requirements and ensure that construction on Midtown Tower continues without interruption."
Judge Harrison read through the document, nodding slowly. "And regarding Mr. Bennett’s shares?"
"We are requesting that the court enforce the mandatory transfer of Mr. Bennett’s fifty-one percent voting interest to Mrs. Bennett, at a valuation determined by an independent special master, less the damages caused by the illegal diversion of company funds."
Judge Harrison looked up from the bench, her gaze landing squarely on Grant.
"Mr. Bennett, you have used this court's jurisdiction to conduct business for nearly a decade. But what I see in these filings is not merely a breach of fiduciary duty; it is a calculated, systematic fraud designed to enrich yourself and third parties at the expense of your partner and the city of Atlanta."
She picked up her gavel.
"Plaintiff’s motion is granted in its entirety. Claire Bennett is appointed temporary sole managing receiver of Bennett Crest Development, effective immediately. Grant Bennett’s corporate authority is terminated, and all personal accounts remain frozen pending the completion of the forensic accounting report. Furthermore, this court will be forwarding this file to the Fulton County District Attorney’s Special Prosecutions Division for criminal review."
Bang.

The sound of the gavel hitting the wooden sound block echoed through the room like a gunshot.
Grant did not move. He sat motionless, staring at the desk as reporters in the back row rushed out the double doors to file their stories.
