Chapter 11 - The Terms of Surrender

I stood up, smoothed down the front of my canvas jacket, and stepped up to the podium.

"Your Honor," I said clearly. "I never had an issue with the drivers. My issue was with an HOA that thought money could buy out a family’s hundred-year legacy through bullying and lies."

I looked across the aisle at Harrison Thorne, who stood waiting patiently.

"I have reached an agreement in principle with Mr. Thorne and the receiver board of Mercer Ridge," I told the judge. "The boulders will be moved this afternoon under three conditions, certified by this court."

Judge Martinez picked up his pen. "State them for the record, Mr. Mercer."

"First: Mercer Ridge will enter into a permanent conservation easement over the entire lower canyon parcel, transferring all access rights to the county land trust. They will never again pave, grade, or construct any commercial road through my timber."

"Recorded," Judge Martinez nodded.

"Second: The HOA will pay three hundred and fifty thousand dollars in direct environmental restitution to restore the headgate at Mercer Creek and reseed the pastures damaged by their contractors."

"Done," Thorne said aloud from his seat.

"And third," I continued, turning my eyes directly onto Victoria Mercer, who was trembling with quiet fury. "The evacuation of those vehicles will take place at a strict speed limit of five miles per hour, under the direct supervision of Sheriff Owens and the Garfield County Cattlemen's Association. And every single transport truck that enters my canyon will pay a two-hundred-dollar private road toll, with one hundred percent of the proceeds going directly to the Glenwood Springs High School Agricultural Scholarship Fund."

A ripple of laughter swept through the local ranchers in the gallery.

Judge Martinez couldn't entirely hide a smirk. "Counsel for the HOA—do you accept these terms?"

Thorne stepped forward immediately. "The receiver board accepts every term unconditionally, Your Honor. The restitution funds are ready for escrow wire transfer within the hour."

Judge Martinez signed the decree with a flourish, his pen scratching loudly against the heavy parchment.

"So ordered," Martinez said, slamming the gavel down with finality. "Court is adjourned. Sheriff Owens, you are directed to oversee the evacuation according to Mr. Mercer's schedule."
