Chapter 10 - The Forensic Audit

The courtroom didn't empty after Judge Martinez's opening remarks. It transformed into an execution chamber for the Mercer Ridge board.
Harrison Thorne rose from the gallery behind us. He walked past the wooden divider, accompanied by a woman carrying three oversized leather binders.
"Your Honor," Thorne addressed the bench with absolute authority. "I am Harrison Thorne, managing director of Aspen Crest. With the court’s permission, our forensic accounting team wishes to submit Exhibit G."
Judge Martinez gestured for Thorne to approach. "Proceed, Mr. Thorne."
"Over the last forty-eight hours," Thorne stated, his voice echoing cleanly off the oak walls, "an emergency audit of the Mercer Ridge operating accounts revealed that Mrs. Mercer has diverted two point four million dollars in HOA maintenance reserve funds over the last eighteen months. Those funds were not used for mountain maintenance. They were used to illegally pave Mr. Mercer's private logging pass and to pay off municipal zoning consultants in an effort to push through the Mercer Ridge Grand Prix without county oversight."
Victoria jumped to her feet. "That's a lie! That money was allocated for regional infrastructure expansion!"
"Silence, Mrs. Mercer!" Judge Martinez warned, pointing his gavel at her. "One more outburst and you will spend thirty days in county jail for contempt."
Thorne didn't even look at her. "The board of directors met at six this morning. By unanimous vote of all equity partners, Victoria Mercer has been formally removed as HOA president, her voting shares have been frozen, and a criminal referral has been submitted to the Colorado Attorney General's Special Prosecutions Unit."
I leaned back in my chair. Sarah Jenkins nudged my arm with a quiet smile.
Across the aisle, Victoria’s high-priced New York attorneys were already packing their briefcases. They knew when a case was dead. They weren't going to sink their reputations defending a disgraced board president who was staring down the barrel of wire fraud, environmental tampering, and perjury charges.
Judge Martinez turned back to Daniel.
"Mr. Mercer," the judge said, his tone softening noticeably. "The court finds that Mercer Pass Road is, and has always been, your private property. The HOA’s petition for an emergency injunction is denied with prejudice. You have no legal obligation to allow a single vehicle across your land."

The gallery erupted into applause. Toby let out a low whistle of victory from the third row.
Judge Martinez brought the gavel down three times to restore order, then looked back at me over his glasses. "However, Mr. Mercer... the court is faced with thirty very expensive, very noisy cars stranded on that ridge, along with drivers who are technically innocent of Mrs. Mercer's fraud. What is your pleasure regarding their evacuation?"
