Chapter 8 - The Emergency Motion

At 2:15 p.m., the heavy mahogany doors of Judge Marilyn Vance’s private judicial chambers clicked shut.
The room was quiet, smelling of old leather bindings and fresh printer toner. Judge Vance sat behind an imposing walnut desk, still wearing her judicial robes from her afternoon motion calendar. Flanking her left side was Dr. Eleanor Wallace, who had been summoned directly by the court to deliver an emergency oral summary of her custody findings.
Sarah Lin and I sat on the right side of the conference table.
On the left sat Richard Vance, looking visibly exhausted and unnerved, with Nathan seated beside him. Nathan’s eyes were darting around the room like a trapped animal. The arrogant, composed professional who had sneered at me in the dance auditorium lobby had completely vanished. His tie was slightly crooked, his hair unbrushed, and his skin had a pasty, sickly pallor.
“We are on the record in chambers,” Judge Vance stated, her voice chillingly quiet. “This emergency conference was convened pursuant to an urgent report submitted to this Court by Dr. Eleanor Wallace, and an Ex Parte Application for Emergency Protective Relief filed by Petitioner.”
Judge Vance turned her piercing gaze toward Dr. Wallace. “Dr. Wallace, please state your findings for the record.”
Dr. Wallace opened her leather folder. Her voice was steady, clinical, and devastating.
“Your Honor, over the past seven days, I have observed a continuous, escalating pattern of coercive control, public intimidation, and severe emotional harassment perpetrated by Mr. Nathan Mercer against both Petitioner and the minor child, Lila Mercer.”
Nathan shifted in his chair, opening his mouth: “Your Honor, that is an outrageous—”
BANG.
Judge Vance’s palm struck the solid wood of her desk. The sound cracked through the room like a gunshot.
“Mr. Mercer,” Judge Vance warned, her eyes burning with pure fury. “If you utter one more syllable without my express permission, I will have the bailiff take you into custody for criminal contempt before you can draw your next breath. Sit back and close your mouth.”
Nathan sank into his chair, his face turning an ash-gray color.
“Proceed, Dr. Wallace,” the judge said.
“On Friday evening,” Dr. Wallace continued smoothly, “Mr. Mercer arrived unannounced at Petitioner’s residence during my confidential clinical observation. He attempted to force entry through a locked door, shouted accusations, struck the door, and caused extreme emotional distress to the child, who was cowering in fear. Furthermore, my interviews with the child reveal that Mr. Mercer has repeatedly used communication channels during school hours to psychologically manipulate her regarding her schooling and home stability. In my thirty years of forensic practice, I have rarely seen a more egregious example of parental boundary violations. It is my firm clinical recommendation that all unsupervised contact between Mr. Mercer and Lila be suspended immediately.”
Richard Vance cleared his throat nervously, adjusting his papers. “Your Honor, while my client’s actions on Friday were regrettable and born of emotional stress regarding his partner’s sudden absence, suspending custody is an extreme remedy—”
“We are not finished, Mr. Vance,” Judge Vance interrupted coldly. She turned to Sarah. “Ms. Lin, present your financial filings.”
Sarah stood up, laying three thick, bound copies of Marcus Vance’s forensic accounting report on the center of the desk.
“Your Honor,” Sarah said, “this is the independent forensic audit conducted by Marcus Vance, CPA, based on primary corporate ledgers. It establishes that Mr. Mercer has systematically embezzled over seven hundred and forty thousand dollars from clients of Crestview Financial Partners, laundered through Mercer Advisory LLC into an undisclosed Delaware entity called Blue Ridge Asset Holdings, which currently owns two luxury condominiums in Wisconsin and a three-hundred-thousand-dollar liquid brokerage account.”
Richard Vance’s jaw literally dropped. He turned to look at Nathan, his eyes wide with sheer professional horror. “Nathan... what is this?”
Nathan stared at the document on the desk. His hands began to shake uncontrollably.
“Furthermore,” Sarah added, “on October 12th, Mr. Mercer filed a sworn financial statement in this court declaring under penalty of perjury that he possessed zero real estate assets and that his business had a negative valuation. That constitutes felony perjury, grand theft, and willful fraud upon this Court.”
The silence in the room was suffocating.
Judge Vance slowly turned the pages of the audit report. Her expression went from stern judicial irritation to cold, stony disgust.
“Mr. Vance,” Judge Vance whispered, her voice dangerously quiet. “Did you have knowledge of these undisclosed assets when you submitted your client’s sworn financial affidavit to this bench?”
“No, Your Honor!” Richard Vance stammered, raising his hands in immediate retreat. “Absolutely not! I was provided these figures by my client under his verified signature. If these records are authentic, I have been fundamentally misled.”
“They are authentic,” Judge Vance said, closing the binder with a dull thud.
She took off her glasses, looking directly at Nathan Mercer.
“Mr. Mercer, in my twenty-two years on the bench, I have rarely encountered a litigant who displayed such utter contempt for the law, for the truth, and for the emotional well-being of his own child. You stood in my courtroom last week and feigned righteous indignation over twenty-four thousand dollars, while hiding nearly three-quarters of a million dollars in stolen funds.”
Nathan looked up, his voice cracking, desperate and hollow. “Marilyn... Your Honor, please. Vivian is orchestrating this. She contacted Brooke, she stole those files—”
“Silence!” Judge Vance commanded.
She picked up her fountain pen and began signing the orders Sarah had drafted.
“Effective immediately:
Petitioner Vivian Mercer is awarded sole legal and sole physical custody of the minor child, Lila Mercer.
Respondent Nathan Mercer’s parenting time is suspended entirely pending full psychological evaluation. Any future contact shall be strictly supervised at a professional therapeutic facility, at Respondent’s sole expense.
An immediate, comprehensive asset freeze is placed upon all accounts associated with Nathan Mercer, Mercer Advisory LLC, and Blue Ridge Asset Holdings. A court-appointed receiver will assume control of all business operations by tomorrow morning.
The Clerk of this Court is formally instructed to transmit this complete record, including all forensic exhibits and transcripts, to the Office of the State Attorney General and the County District Attorney for immediate criminal investigation into grand larceny, fraud, and perjury.”
Judge Vance looked up, handing the signed orders to the clerk.

“We are adjourned. Mr. Mercer, I suggest you retain a criminal defense attorney immediately.”
Nathan sat frozen in his chair, staring at the polished wood table as the legal world he had built to destroy me collapsed irrevocably upon his head.
